California Volkswagen Lawsuit Claims “CleanDiesel” Models Sold By Volkswagen Were Defective
On October 9, 2015, a Lawsuit was filed against Volkswagen Group of America, Inc. stating the auto manufacturer instituted software called a "defeat device" in their vehicles designed to detect an emissions test and emit lower emissions during the test.
The lawsuit claims that during normal driving conditions Volkswagen's diesel cars emitted far higher levels of pollutants. The lawsuit further claims that Volkswagen's representations that its diesel vehicles were good for the environment and met emissions requirements were deliberate lies. The case entitled Gomez, et al. v. Volkswagen Group of America, Inc., Case No. 2:15-cv-7962 is currently pending in the United States District Court for the Central District of California. The Complaint says that Plaintiffs purchased Volkswagen's "CleanDiesel" cars based on Volkswagen's fraudulent assertions that its "CleanDiesel" vehicles met U.S. federal and state emissions standards. However, the Complaint claims that Plaintiffs are now stuck with cars that do not meet emissions standards and emit far higher levels of pollutants than Volkswagen claimed. The Complaint claims that the cars are now worth considerably less because of the fraud.
On September 18, 2015, The Environmental Protection Agency accused Volkswagen of installing software on 482,000 diesel cars in the U.S. to evade federal emission regulations, potentially exposing people to harmful pollutants.
